CALL TO ACTION -- CALL YOUR SENATORS, NOW

This Washington Wire deals with two specific issues of great importance to the National Rehabilitation Association: The WIA PLUS BLOCK GRANT proposal; and the proposed closing of RSA's Regional Office and the possible -- some say probable -- outsourcing of RSA's Regional staff's jobs.
The U.S. Senate stands in recess until Monday, May 9, 2005. The U.S. House of Representatives remains in session this week.
It is anticipated at this time that the Senate WIA bill will be introduced early next week and that markup of the bill may occur on May 11, 2005, a very abbreviated timeline in which to read the Senate WIA bill before it is marked up in the full Committee on Health, Education Labor and Pensions (HELP).
Because Senators are back in their home States and because the staffs of the Senate HELP Committee and the House Education and the Workforce Committee are meeting on the bill which will ultimately emerge as the Senate WIA bill, now is an opportune time to contact your Senators in your States with the following message.
To the best of our knowledge, information and belief at this time, WIA PLUS has not been added to the Senate WIA bill. As you MAY recall, the House Committee on Education and the Workforce REJECTED the WIA PLUS BLOCK GRANT amendment during its deliberations of the House WIA bill, H.R. 27. And, why did so many Members of Congress reject this misguided approach to VR because many knew it was just not the right thing to do.
Now is the time for you to thank your Senator for not supporting the inclusion of the WIA PLUS BLOCK GRANT PROPOSAL AND TO EXPRESS YOUR CONTINUING CONCERN ABOUT ANY ATTEMPT BY GOVERNORS OR OTHERS TO INCLUDE THIS MISGUIDED BLOCK GRANT INTO THE SENATE WIA BILL.
By way of a brief background, the WIA PLUS BLOCK GRANT AMENDMENT would allow Governors to take VR money and use those precious funds -- specifically earmarked for individuals with disabilities -- for any purpose that the Governor(s) deem appropriate. THE WIA PLUS BLOCK GRANT IS A VIOLATION OF THE REHABILITATION ACT OF 1973, AS AMENDED, AND VIOLATES THE INTENT OF CONGRESS THAT FUNDS FOR INDIVIDUALS WITH DISABILITIES WHO SEEK ECONOMIC INDEPENDENCE COULD ONLY BE USED FOR THAT PURPOSE.
If the WIA PLUS BLOCK GRANT AMENDMENT WERE TO BE INCLUDED IN THE SENATE WIA BILL, THE VR PROGRAM WOULD LOSE ITS IDENITY, THEN ITS ADVOCACY AND THEN ITS DOLLARS.
IF THE WIA PLUS BLOCK GRANT AMENDMENT WERE TO BE INCLUDED IN THE SENATE BILL OR IN THE CONFERENCE WITH THE HOUSE BILL, THE PUBLIC/PRIVATE VR PARTNERSHIP WOULD DISAPPEAR, PERHAPS NOT OVERNIGHT, BUT OVER A SHORT PERIOD OF TIME.
WE CANNOT AND WILL NOT LET THIS HAPPEN.
As always, when dealing with everyone, please continue to be respectful and responsible in your telephone conversations or written correspondence (which must be faxed, not mailed) to your Senator(s).
And, please remember that when speaking with staff to the Senator that this is almost as important (and perhaps in some cases, more important) than speaking to the Senators themselves because that staffer will carry your message back to the Senator based upon your presentation of the message to be conveyed.
The other issue of great concern to the National Rehabilitation Association is the proposed closing -- AND POSSIBLE OUTSOURCING OF JOBS -- of the Rehabilitation Services Administration’s (RSA) Regional Offices which provide ongoing and excellent technical assistance to the States and monitoring activities which, as a former RSA staffer, I believe are far superior to those in other components of the U.S. Department of Education. This misguided decision is that of the U.S. Department of Education's Office of Special Education and Rehabilitative Services (OSERS).
To the best of our knowledge there are 1,400 individuals employed in the Regions by the U.S. Department of Education, yet ONLY RSA'S REGIONAL OFFICE STAFF (66 EMPLOYEES) HAVE BEEN TARGETED FOR EXTINCTION WITHOUT SHOWING GOOD CAUSE FOR THIS DISMANTLING.
And, where's the plan? THERE IS NO PLAN to replace the enormous expertise and amount of work that these dedicated individuals have provided over the years to our State VR Agencies, individuals with disabilities who seek the dignity of work and living independently, and others.
Certain employees of the Office of Special Education and Rehabilitative Services (OSERS) -- who do NOT possess in-depth knowledge -- or knowledge generally -- of the VR program -- have said that the Central Office (CO) staff can assume the duties and responsibilities of the Regional RSA staff. None of these people who have been placed in charge of the proposed dismantling of RSA's Regional Offices -- to the best of my knowledge -- have ever been involved with or in monitoring activities -- nor as we have said above -- possess the knowledge and expertise in the VR Program.
We know the RSA Central Office staff is both excellent and hard working -- and believe they are among not only the best staff in all of OSERS but in the U.S. Department of Education, generally.
That said, these dedicated individuals have an already overextended workload, especially now since the former Acting Assistant Secretary of OSERS summarily snatched 3 RSA employees and reassigned them to the Office of the Assistant Secretary (OAS). Why? Because as we have said for months, the Office of the Assistant Secretary of OSERS simply has not -- and never has had -- the expertise in the Public Private VR Partnership Program.
SO, WHAT'S NEXT? WHO'S GOING TO PERFORM THE DUTIES OF THE REGIONAL OFFICE STAFF?
IS OSERS GETTING READ TO OURSOURCE THESE POSITIONS?
I BELIEVE THE ANSWER IS YES AND YOU MUST CONTACT YOUR SENATORS RIGHT NOW AND TELL YOUR SENATORS THAT OUTSOURCING THE EXPERTISE OF THE RSA PERSONNEL WILL NOT RESULT IN BETTER MONITORING AND WILL RESULT IN 66 DEDICATED EMPLOYEES -- MANY OF WHOM ARE INDIVIDUALS WITH SIGNIFICANT DISAIBLITIES -- LOSING THEIR JOBS AND EQUALLY IMPORTANTLY WILL NOT SERVE INDIVIDUALS WITH DISABILITIES IN EITHER THE SHORT OR LONG TERM.
OUTSOURCING THE REGIONAL OFFICE STAFF POSITIONS WILL -- IN ALL PROBABILITY COST MORE MONEY -- NOT SAVE MONEY -- THAN LEAVING THE PRESENT EXCELLENT MONITORING INSTRUMENT IN PLACE.
OUTSOURCING OF ANY VR ADMINISTRATIVE FUNCTION IS THE SLIPPERY SLOPE TO THE PRIVATIZATION OF THE VR PROGRAM.
HAVEN'T WE ALL LEARNED OUR LESSON WITH THE FAILED PRIVATIZATION OF THE VR PROGRAM IN FLORIDA DURING WHICH HUNDREDS OF INDIVIDUALS WITH DISABILITIES WERE DENIED SERVICES, MANY QUALIFIED VR COUNSELORS WERE FORCED INTO RETIREMENT, OR FORCED TO QUIT -- OR WERE JUST FIRED.
The Public/Private VR Partnership has worked well for decades and the structure that is presently in place to continue that successful partnership should remain in place.
Many disABILITY advocacy organizations, including The National Rehabilitation Association, have signed on to recently-re-introduced legislation, H.R. 1480, The Federal Employees with Disabilities Protection Act (FEDPA).
H.R. 1480 simply states that in cases were FEDERAL JOBS ARE CONTRACTED OUT, A FEDERAL EMPLOYEE SHOULD NOT LOSE HIS OR HER JOB IF THAT EMPLOYEE IS AN INDIVIDUAL WITH A SIGNIFCANT PHYSICAL OR DEVELOPMENTAL DISABILITY.
Numerous disability organizations have signed on to this legislation, including the Consortium of Citizens With Disabilities (CCD).
Other organizations that have signed on to H.R. 1480 include: ADA Watch/National Coalition for Disability Rights; American Association of People With Disabilities (AAPD); American Association on Mental Retardation (AAMR); American Council of the Blind (ACB); American Counseling Association (ACA); American Network of Community Options and Resources (ANCOR); American Occupational Therapy Association AOTA); APSE: The Network on Employment; Association of University Centers of Disabilities; Brain Injury Association of America (BIAA); Council of State Administrators of Vocational Rehabilitation (CSAVR); Easter Seals; Goodwill Industries; Helen Keller National Center; Inter-National Association of Business Industry and Rehabilitation (I-NABIR); Learning Disabilities Association of America (LDAA); National Association of Councils on Developmental Disabilities (NACDD); National Association of Protection and Advocacy Systems (NAPAS); National Coalition on Deaf-Blindness; National Down Syndrome Congress (NDSC); National Rehabilitation Association (NRA); NISH; Paralyzed Veterans of America (PVA); Research Institute of Independent Living; SEEC; Spina Bifida Association of America; The ARC of the United States; United Cerebral Palsy (UCP); United States Psychiatric Rehabilitation Association; Federal Employee Unions; National Association of Government Employees (NAGE); Service Employees International Union (SEIU), and others.
The National Rehabilitation Association has always felt strongly that one Federal job of an individual with a disability -- or individuals who are providing much-needed services and supports to individuals with disabilities -- should not have their jobs outsourced to those who know very little -- if anything -- about the Public/Private VR Partnership's monitoring and technical assistance activities.
The Rehabilitation Services Administration is the Federal agency with the expertise in and responsibility for the administration of the programs administered under the Rehabilitation Act of 1973, as amended. RSA employs more individuals with disabilities that any other Federal agency to the best of our knowledge.
Say NO to the dismantling of RSA's Regional Offices and advise your Senators that this decision -- which was done by administrative fiat by those in the Office of the Assistant Secretary of OSERS who do not have the expertise or experience in this program did not think through this disastrous decision which can only hurt not only individuals with disabilities but the primary public/private VR partnership that serves and has served individuals with disabilities who seek the dignity of economic independence for over 8 decades.
